Subject: Mr. Ahmed Ali, Senior Auditor (BPS-16), Directorate of Budget & Accounts, Pakistan Public Works Department (Pak PWD), Islamabad — charged with inefficiency and misconduct under Rule 3(b) of the Civil Servants (Efficiency & Discipline) Rules, 2020.
Summary of allegations and chronology:
- Mr. Ahmed Ali was granted two years ex-Pakistan leave (E.O.L.) effective from 2022-02-21 to 2024-02-20 and was expected to resume duty on 2024-02-21.
- He was directed to join immediately by letter No. Admin/PF 466/3025 dated 2024-02-28 issued by the DBA Pak PWD, Islamabad. Instead of joining, he tendered a resignation from the post of Senior Auditor (BPS-16) on 2024-02-29 while absent from office, which is alleged to violate the prescribed procedure for resignation under Government service rules (Sr. No. 09(2) and 10(c) of Esta Code edition 2007).
- He was again directed to join by the DBA Pak PWD by a letter dated 2025-01-10 but failed to comply. His conduct is considered a failure to perform official duties and prima facie misconduct under Rule 3(b) of the Civil Servants (Efficiency & Discipline) Rules, 2020.
Action required and consequences:
- Under the cited disciplinary rules, the matter may result in imposition of one or more penalties including major penalty of dismissal from service as permitted under Rule 4(3)(e) of the Civil Servants (Efficiency & Discipline) Rules, 2020.
- Mr. Ahmed Ali is called upon to submit a written explanation (show-cause reply) within fourteen (14) days from the receipt of this notice under Rule 7(b) of the Civil Servants (Efficiency & Discipline) Rules, 2020, explaining why disciplinary action should not be initiated or upheld.
- If no reply is received within the stipulated period, it will be presumed that he has no defense and ex-parte disciplinary action may be taken under Rule 4(1) of the Civil Servants (Efficiency & Discipline) Rules, 2020, which could lead to dismissal or other penalties.
