The highest bidder's Rs. 500,000 CDR will be retained at the fall of the hammer and credited to the Cantonment Fund as advance rent. The remaining rent will be collected monthly. The highest bidder must deposit refundable security of Rs. 1,579,000 with the Board within seven days of completion of the auction proceedings.

If the highest bidder fails to deposit the refundable security within seven days, the Rs. 500,000 CDR will be forfeited. The second-highest bidder will then be offered the opportunity to match the highest bid and deposit Rs. 1,579,000 security within seven days. If the second-highest bidder accepts, their retained Rs. 500,000 CDR will be deposited in the Cantonment Fund as advance rent.

Tenancy conditions: The tenant must comply with conditions imposed from time to time by the Military Lands and Cantonments Department, Ministry of Defence or other relevant government departments concerning tenancy rights. The bidder must also comply with additional Board requirements or restrictions relating to use and maintenance of the site throughout the tenancy.

Renewal is limited to two tenures of similar duration. Before renewal of each tenure, a feasibility study must include a market survey, analysis and assessment of the prevailing market trend. Each renewal, after every ten years, requires an additional payment equal to 25% of the initial refundable security. Annual rent increases will be at least 10%, with reasonable adjustments for prevailing inflation.

Subletting requires the Board's approval and payment of the fee determined by the Board. The tenant's agreement with a subtenant must remain within the provisions of the principal tenancy agreement between the Board and the tenant. Tenancy rights may be transferred subject to payment of the Board's transfer fee and provision of security equal to that refunded to the outgoing tenant. A new agreement will be executed with the incoming tenant for the remaining tenancy period.

Any additions or alterations to the building require Board approval and must be carried out at the tenant's expense. Such additions or alterations will become the property of Cantonment Board Kohat upon expiry of the tenancy. The existing tenant will have the first right of refusal after completion of the first and second tenancy terms. If the tenant refuses an extension, the tenancy rights will be re-auctioned.

Business approvals and operating expenses: The successful bidder must obtain any NOCs required for the business operating at the site. Electricity, water and other allied services must be arranged at the bidder's expense. The tenant will bear all taxes, utility bills, repair and maintenance expenses, licence fees, conservancy charges and other charges. Where required, the successful bidder must install an electric meter or solar system at their own expense after obtaining an NOC from Cantonment Board Kohat.

Rent payment and default: Monthly rent must be deposited in the Cantonment Fund Account on or before the 10th of each month. Late payment carries a fine of 1% of the monthly rent. Failure to deposit rent for three consecutive months will result in cancellation of the agreement and forfeiture of the CDR deposit by Cantonment Board Kohat.

The tenancy agreement and security must be registered with the Sub-Registrar, Kohat, under the Registration Act, 1908, at the tenant's expense. After expiry of the tenancy, refundable security will be returned after adjustment of the tenant's liabilities, clearance by a committee established by the CEO or Board at the relevant time, and completion of the audit for the relevant financial year. The property's tenancy rights will be re-auctioned after expiry of the total 30-year tenancy period.

Legal and regulatory requirements: Bidders must comply with local building codes, zoning laws and environmental regulations, obtain necessary permits and approvals from relevant authorities, and protect intellectual property rights relating to the design. Prospective bidders must certify that they have not been blacklisted, declared defaulters or debarred by any government or semi-government department in Pakistan. An undertaking to this effect must be submitted to Cantonment Board Kohat on Rs. 1,200 stamp paper.

Only financially sound firms with extensive experience in running petrol pumps will be allowed to participate. If the Board requires the site to be vacated at a subsequent stage for its own requirements or legal completion, it will pay the tenant the cost of the superstructure provided at the time of submission of the building plan.

Dispute resolution: Any dispute with Cantonment Board Kohat must be referred to the Director Military Lands and Cantonments, Peshawar Region, Peshawar, for arbitration. The arbitrator's decision will be binding and cannot be contested in a court of law.
