Banking Court Karachi Auction of Flat in Billy’s Heights on 5 December 2024

Banking Court No. 1, Karachi, before Judge Muhammad Saad Qureshi, has ordered a public auction of the mortgaged property in Execution No. 11 of 2020, arising from Suit No. 202 of 2014: House Building Finance Company, decree holder, versus Majan Soomro, son of Muhammad Salah Soomro, judgment debtor.

The sale is ordered under Order XXI, Rule 64 of the Code of Civil Procedure, 1908, towards satisfaction of the decree for Rs. 630,000, together with costs and cost of funds calculated until realization of the decretal amount. The auction will take place at the mortgaged property on 5 December 2024 at 1:00 PM.

The judgment debtor’s address is Flat C-0081, Block 18, Billy’s Paradise-II, Scheme 36, Gulistan-e-Johar, Karachi.

The property will be auctioned on an “as is, where is” basis. The highest bidder or purchaser must immediately deposit 25% of the bid amount through a pay order in favour of Nazir, Banking Court No. 1, Karachi, accompanied by a photocopy of the purchaser’s CNIC. Cheques and cash will not be accepted.

The remaining purchase price must be paid before the court closes on the fifteenth day after the auction. If the purchaser fails to pay the balance within 15 days, the 25% deposit will be forfeited. All government taxes and dues are payable by the auction purchaser.

The sale is subject to confirmation by the court. The court reserves the right to cancel the auction, reject any bid even if it is the highest, or defer the auction at any time.

The notice was issued under the hand and seal of Banking Court No. 1, Karachi, on 2 November 2024, by order of Ahmed Sohail Mahesar, Nazir. The court is located at Block No. 51, Pakistan Secretariat, Saddar, Karachi.
