The proceedings are instituted under Section 9(1) of the Financial Institutions (Recovery of Finances) Ordinance, 2001, Ordinance XLVI of 2001. The defendant must obtain leave to defend the suit by submitting an application within 30 days of the first service of summons. The application must be supported by an affidavit in accordance with the Ordinance.
