Public Notice — Unauthorized Use of the 'SAIF' / 'SAIF GROUP' Trademark

Issuer: Saif Group. This public notice declares Saif Group as the sole legal and equitable proprietor of the trademarks/trade name/house marks “SAIF” and/or “SAIF GROUP”, duly registered with the Intellectual Property Organization of Pakistan.

Purpose: To notify the public and trade that certain individuals/parties have unauthorizedly adopted and used the mark “SAIF” and/or “SAIF GROUP” in relation to real estate and construction activities, causing confusion and deception among consumers and trade.

Legal action taken: A suit for infringement, passing off, unfair competition and damages has been filed (Intellectual Property Tribunal, Rawalpindi; suit reference indicated on notice). The Learned Intellectual Property Tribunal, Rawalpindi has granted a stay order restraining the unauthorized parties from using the mark “SAIF” and/or “SAIF GROUP” in any manner. The Honorable Lahore High Court, Rawalpindi Bench has also passed an appropriate order in view of Saif Group’s contention, goodwill and reputation.

Warning & remedies: The public, regulators, trade authorities, customers, dealers, e-commerce platforms and trade channels are advised to be cautious before dealing with goods/services offered under the unauthorized mark, which has no nexus/association with Saif Group. Saif Group reserves all rights and remedies under law, including injunctive relief, damages, rendition of accounts, delivery-up and all other civil and criminal remedies available under applicable law.
