Banking Court V Karachi Summons Faizan Mirza in Albaraka Bank Recovery Suit No. 184 of 2026

Dr. Hatim Aziz Solangi, Judge of Banking Court No. V at Karachi, has issued summons in Suit No. 184 of 2026, filed by M/s. Albaraka Bank (Pakistan) Limited against Faizan Mirza, son of Nayab Mirza. The court is located at Block No. 48-C, Pakistan Secretariat, Saddar, Karachi.

The plaintiff has instituted a suit for recovery of Rs. 17,346,905, together with liquidated damages/charity, cost-of-funds charges and costs until realization of the entire amount, under Section 9 of the Financial Institutions (Recovery of Finances) Ordinance, No. XLVI of 2001.

The defendant is summoned to appear before the court on December 3, 2026, at 8:30 a.m. and must apply for leave to defend the suit within 30 days of service of the summons. In the event of default, the plaintiff will be entitled, after expiry of that 30-day period, to obtain a decree with costs and such markup or interest as the court may order.

The application for leave to defend must be in the form of a written statement and contain a summary of the substantial questions of law and fact for which, in the defendant's opinion, evidence is required to be recorded, as provided in Section 10 of the ordinance.
